What to do in the event of a claim

It is the duty of the Insured to take such measures as may be reasonable for the purpose of averting or minimising a loss and to ensure that all rights against Carriers, Bailees or other third parties are properly preserved and exercised. Specifically, it is very important that when you are asked to sign for your property on delivery, that you clearly record any discrepancies or, if there is no opportunity to inspect the property, that you record that fact on the Delivery Note. You must then write as quickly as possible to whomever delivered your property confirming any damages or missing items and holding them responsible.

In the event of loss or damage which may involve a claim under this contract of insurance, please give immediate notice with an indication of the extent of the loss or damage to:

The following documents should be submitted to support the claim as soon as possible:

  1. The Certificate of Insurance issued to you by A Letton Percival & Co Ltd.
  2. The Original Bill of Lading (Sea Freight) or Airwaybill (Air Freight) or other Contract of Carriage which should have been given to you by the Remover/Freight Forwarder in the country of departure. Obtain a copy from them if you cannot trace the Original.
  3. A copy of the Delivery Note/Receipt that you signed on final delivery.
  4. Correspondence exchanged with the Carriers and other third parties regarding their liability for the loss or damage.
  5. Details of the lost/damaged items, estimated cost of repair for those items which can be repaired or values for those items lost or beyond repair. NB. Your insurance covers the reasonable cost of obtaining repair estimates.
  6. Any photographs that you have taken of the goods and/or the packing.

A decision will then be made as to whether or not to appoint a Surveyor and A Letton Percival or the Surveyor will then progress the claim with you.
